Affidavit: Man pulls gun on victim, threatens to kill her after seeing text from ex-husband

Jonesboro, AR – (JonesboroRightNow.com) – A man is facing multiple charges after police said he attacked a victim, injured her, and threatened to kill her, himself, and officers after seeing a text from her ex-husband while holding her phone.

District Judge David Boling found probable cause Nov. 12 to charge 26-year-old Joshua William Midgett, of Owasso, OK, with the following:

  • Class D Felony: Aggravated assault on a family of household member
  • Class D Felony: First-degree terroristic threatening (threatens physical injury or property damage)
  • Class A Misdemeanor: Third-degree domestic battery
  • Class A Misdemeanor: First-degree interference with emergency communication
  • Class A Misdemeanor: First-degree criminal mischief (property of another with a value of $1,000 or less)

According to the affidavit, on Nov.11, Jonesboro police were dispatched to a home for a domestic disturbance. On arrival, they met the victim and told them that Midgett, who she had been romantically involved with, attacked her.

She told police she and Midgett had been at her home and took a nap on the couch. When they woke up, the victim said Midgett could not find his phone, so he borrowed the victim’s phone to use the flashlight. While he had the phone, she received a text from her ex-husband, angering him.

The affidavit said that Midgett began yelling and screaming at her. Later, when the victim went to take a shower, Midgett came into the bathroom and began yelling at her there. He then pulled at the shower curtain, ripping it down and damaging the wall. Midgett got into the victim’s shower, grabbed her and pulled her out of the shower and onto the floor.

The victim told police that when, she was pulled out, her foot caught on something, causing “a significant cut” on her foot. Midgett then dragged the victim to the living room, put her on the couch, and began hitting her.

While on the victim, Midgett got a handgun out and pointed it at her, saying that he was going to kill her and himself and shoot the police if she called them, according to the affidavit. The victim said Midgett then placed the gun on a table and walked away from her. The victim took the gun and hid it in the bathroom so he could not find it. Midgett then took the victim’s phone and broke it after talking about calling police. However, the victim was able to get out of the house and go to a neighbor’s home to call police.

The affidavit said that, when police arrived, Midgett was no longer at the home. They noted the broken cell phone, and the victim showed them where she hid the gun and her cut foot, with blood being found in the bathroom.

Officers were able to find Midgett later in the day and arrested him at 8:26 p.m., according to the online jail roster.

Due to this being his second felony arrest and him living out of state, Midgett was given a $75,000 cash/surety bond and ordered to have no contact with the victim.

Midgett’s next court appearance is scheduled for Dec. 16.
